New maternity legislation passed in October 2024 introduced an Employee right to postpone maternity leave for a period of between 5 and 52 weeks to allow access to treatment for a serious medical reason.
Under the legislation, a ‘serious health condition’ entails a serious risk to the life or health, including the mental health, of an Employee, that requires necessary medical intervention.
Postponing maternity leave will not sacrifice other forms of leave, such as unpaid maternity leave and parent’s leave.
